The members of Rajya Sabha of India of India changes in certain provisions of the Surrogacy (Regulation) Bill 2019, which will mandates that only a close relative can be a surrogate mother and provisions of five years of marriage for commissioning parents. The Surrogacy (Regulation) Bill 2019, was introduced in the Upper House (Rajya Sabha of India) by the Health Minister and Family Welfare of India Mr. Harsh Vardhan. It has been passed by the Lok Sabha of India in the Monsoon Session. The participating in the debate, Jairam Ramesh said that it was a very much complicated bill (Surrogacy Bill) and the Government of India should be get an amended bill passed after the considering the suggestions of the members of Rajya Sabha of India.

Regulation of surrogacy (Regulation) Bill 2019

The Bill prohibits commercial surrogacy, but allows altruistic surrogacy. Altruistic surrogacy involves no monetary compensation to the surrogate mother other than the medical expenses and insurance coverage during the pregnancy. Commercial surrogacy includes surrogacy or its related procedures undertaken for a monetary benefit or reward (in cash or kind) exceeding the basic medical expenses and insurance coverage.


Purposes for which surrogacy (Regulation) Bill 2019 is permitted

Surrogacy is permitted when it is-

1. For intending couples who suffer from proven infertility.

2. Altruistic.

3. Not for commercial purposes.

4. Not for producing children for sale, prostitution or other forms of exploitation.

5. For any condition or disease specified through regulations.



Some Important Facts of Surrogacy (Regulation) Bill 2019

1. The Surrogacy (Regulation) bill also has a provision of 10 years of punishment with the non-bailable warrant in case of violation.

2. The government to let Non Resident Indians opt for surrogacy in India under the provisions of the legislation.

3. The Surrogacy (Regulation) bill was silent on same-sex couples and people who were in live -in relationships.

4. The Surrogacy (Regulation) bill has been brought in order to stop the exploitation of surrogate mothers, but in the current form would end up exploiting them more.

5. Medical aid, insurance and other benefits for women who opt to be surrogate mothers.

6. The bill would make it mandatory for the parents to take the child and not abandon even if the gender is not to their liking.

7. The bill is made for all human beings and certain section of the bill are restrictive.

8. The bill seeks to ban commercial surrogacy, provides to set up surrogacy boards at national and state levels, as well as that the intending couples should not abandon such a child under any condition.
